HIStory logo - Updates
I have been informed that the HIStory logo has been cancelled in Germany due to the a 3rd party request (might be the Michael Jackson Estate). The action happened last October.
The trademark "MJ" (the History version) was removed from the trademark register in Germany on October 11, 2011. This means the situation in Germany got remedied (it had been bought by a different company since the company Dieter Wiesner was running for Michael in Germany had gone insolvent). I checked and indeed the German trademark law (§3) states that trademarks can be deleted if they could serve to cheat people into buying goods that are not what they say they are - any product branded as "MJ" (History version) would have qualified for this, easily. The trademark was removed at the request of its current owner, however, a third party had filed a request to remove earlier in 2011. I believe the owner realized (or was made to realize) that the trademark was virtually worthless - because of §3. - I am thankful for the German trademark law to include paragraph 3 among its provisions. -BX
But they're still selling the Jackson Champagne with the trademark MJ (history version).... http://jackson-champagner.com/index.php/jackson-champagner-cuvee-brut-rose-sonderedition.html
Hi everyone! Pardon the interruption, but please check out my tribute to The King Of Pop called "Moves Like Jackson" Thanks so much for your time! Let's keep MJ's magic alive forever! http://www.youtube.com/watch?v=JXpeo1qHgf8
What do you mean by "cancelled"? Do you mean the copyrights were removed from their current owner?
